TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in their entirety. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

These limitations reflect a reasonable allocation of risk between you and Round Table Pizza and are a fundamental element of the basis of the bargain between us. The Services would not be provided without these limitations.

• WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICES;
• WARRANTIES THAT ANY DEFECTS IN THE SERVICES WILL BE CORRECTED.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of the arbitration provisions set forth in Section 12 of these Terms.

To the extent that our Services are accessed by individuals located in California, such individuals may have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), California Civil Code § 1750 et seq. You and Round Table Pizza agree that any Dispute shall be resolved exclusively through final and binding arbitration administered by a nationally recognized arbitration organization, such as the American Arbitration Association (AAA) or JAMS, in accordance with their applicable rules for consumer disputes. The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ROUND TABLE PIZZA AGREE THAT ALL DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. NEITHER YOU NOR ROUND TABLE PIZZA SHALL HAVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR TO HAVE DISPUTES HEARD AND DECIDED BY A JUDGE OR JURY.

12.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information. Small claims court actions that qualify under the applicable small claims court rules are also excluded from mandatory arbitration.
